Areas of Law

Family Law
This area of law includes divorces, divorce mediation, maintenance and domestic violence matters, all of which we are able to assist clients with.
Civil litigation
When parties to a civil dispute can’t agree to a resolution of the issue, the matter is referred to a court by way of an aggrieved party issuing summons or applying to court for the court to rule on the issue.

Debt Collection
Debt collection is the process of recovering payments due to a creditor or someone who is owed money.
Contracts and Commercial law
Contracts include a wide range of agreements. Individuals may enter into agreements pertaining to leasing or sale of property, sale of a motor vehicle, etc.

Divorce
Divorce or the dissolution of marriage is the process of legally terminating a marriage or civil union.

Maintenance
This is the legal obligation of a person who is responsible in terms of the Maintenance Act to provide for the financial needs and upkeep of another person.

Labour law
Employment contracts and codes of conduct, together with the Labour Relations Act govern the relationship between the employer and employee.
Criminal law
When a criminal offence has been allegedly committed and a person has been arrested, he has the right to legal representation from the time of his arrest and throughout his trial. He also has the right to be presumed innocent until proved guilty.

Bail Applications
The accused in a criminal matter is entitled to bail subject to the provisions of the Criminal Procedure Act. The purpose of bail is to secure the release of the accused, pending his trial and to ensure his attendance at the trial. Whether he is found guilty or not, he is entitled to the refund of his bail payment.
Conveyancing
Only owners of a property have unlimited real rights which include the right to sell that property. The selling and buying of immovable property such as houses and apartments requires the transfer of ownership of that property and the registration of a mortgage bond and cancellation thereof, where applicable.

Drafting of Wills and Administration of Deceased Estates
A deceased estate comes into existence when a person dies leaving property or a document which is a will or purports to be a will. Such estate must then be administered and distributed in terms of the deceased’s will or failing a valid will, in terms of the Intestate Succession Act.

Notarial services
By law certain documents must be drafted and attested by a notary, eg. antenuptial (marital) contracts, notarial bonds, real rights of extension, exclusive use areas in sectional title schemes and registration of servitudes as well as long leases

We accept instructions from other law firms to act as their correspondents in Amanzimtoti, Chatsworth, Durban, Nsimbini, Pinetown, Scottburgh, Umlazi, Umbumbulu, Umzinto and Wentworth courts, being all the courts which we normally attend.
